1.2 These Terms affect your legal rights and obligations if you enable the Alexa Skill or Google Action so please read them carefully. If you do not agree to be bound by these Terms, do not enable the Alexa Skill or Google Action, or if you have already done so, please disable the Alexa Skill or Google Action and notify us that you have done so and we shall delete any personal data we have already collected.

1.3 If you have any questions, you can contact us by email. You should also read our Privacy Policy which sets out how we process any personal data that you provide to us.

1.4 We reserve the right to update these Terms from time to time at our discretion. We may do so for technical or legal reasons, or because the needs of our business have changed. If we reasonably believe that the change to the Terms is significant, we shall notify you by email. Otherwise, updated Terms will be effective as soon as they are accessible. You are responsible for regularly reviewing these Terms so that you are aware of any changes to them.

2.1 You can download, view and print all content provided to you or otherwise accessible under the Alexa Skill or Google Action for your own personal use.

2.2 You must not, and must not permit or assist any third party to (a) use the Alexa Skill or Google Action for any illegal or unauthorized use; (b) copy the whole or any part of the Alexa Skill or Google Action nor arrange or create derivative works based on the Alexa Skill or Google Action except to the extent permitted by law not capable of exclusion by agreement; (c) distribute, sell, sub-license, lease, resell or purport to assign access to the Alexa Skill or Google Action; and/or (d) access the Alexa Skill or Google Action only to build a competitive product or service or to build a product using similar ideas, features, functions or graphics.

2.3 From time to time you may be entitled to unlock features of the Voice App on payment of a fee. Payment may be made directly to us or, if permitted, via a third party payment provider. If payment is made via a third party payment provider, we do not receive your payment details. You agree that you cannot cancel the purchase of a feature for your Voice App (and claim a refund) because the feature is immediately downloaded. Your consumer statutory rights are not affected.

3.1 You agree that it is possible that your device may not hear you properly or may misunderstand what you say when using the Alexa Skill or Google Action. You agree that we are not responsible for any inaccuracies in information or content that you may receive from your device as a result of using the Alexa Skill or Google Action.

3.2 In any event, all content provided through the Alexa Skill or Google Action is for information only and you should not rely on it. To the extent permitted by law, and subject to Condition 3.3, the Alexa Skill or Google Action is provided “as is” without any warranties or conditions of any kind in relation to the content, reliability, fitness for purpose, quality and/or functionality.

3.3 If there is a problem with the Alexa Skill or Google Action that damages a device or any other digital content belonging to you and this is caused by our failure to use reasonable Alexa Skill or Google Action and care, we will either repair the damage or pay you compensation up to $40 per device. However, we will not be liable for damage which you could have avoided by following our advice to enable an update offered to you for free, or for damage caused by you failing to correctly follow our instructions or these Terms.

3.4 Nothing in these Terms shall be construed as excluding or limiting our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation or for any other liability that cannot be excluded by USA law.

By downloading and using Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises ("we" or "us") Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises WAP Services (collectively, the "Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises , Service or product"), you accept and agree to be bound by these Terms of Use.Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises may at any time modify these Terms of Use. 

You can review the most current version of it by clicking on the "Terms of Use" link located at the bottom of the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises website. The most current version will supersede all previous versions. Charges for Using the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises, Service

Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises is currently a complimentary service. However, when you use the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service, you may be subject to charges imposed by your wireless or another applicable carrier. Payment of such charges is solely your responsibility.

Registration Data and certain other information about you are subject to our Privacy Policy. For more information, please review our full privacy policy at Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises You understand that through your use of the Service you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States and/or other countries for storage, processing, and use by Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises and its affiliates. MEMBER ACCOUNT, PASSWORD AND SECURITY. You (the “MEMBER”) will receive a password and account designation upon completing the Service’s registration process. You are responsible for maintaining the confidentiality of the password and account designation and are fully responsible for all activities that occur under your password or account designation. You agree to (a) immediately notify v of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

The copyright in the Alexa Skill or Google Action including all information, data, recordings and all source code and other software is owned by us or or licensed to us. All rights are reserved. No rights in the copyright transfer to you under these Terms.

Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises and/or its licensors are the sole owners of the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service, which includes any software, method of doing business, domains, and content made available through it. The Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service is protected by U.S. and international copyright and other intellectual property laws. It is for your own personal and non-commercial use only, and Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises grants you a limited license for that purpose. 

Without limitation, this means that you may not sell, export, license, modify, copy, reverse engineer, distribute or transmit the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service without Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises prior express written permission. They may not be used without Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises prior express written permission. All other trademarks not owned by Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises that appear in connection with the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service are the property of their respective owners, who may or may not be affiliated with, connected to or sponsored by Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises .

By downloading and/or using the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service, you consent to receive electronic communications and notices from Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises. You also agree not to interfere with the servers or networks connected to the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service or to violate any of the procedures, policies or regulations of networks connected to the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service, the terms of which are incorporated herein. 

You also agree not to: (1) impersonate any other person while using the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises Service; (2) conduct yourself in a vulgar, offensive, harassing or objectionable manner while using the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service; (3) use the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service for any unlawful purpose; or (4) resell or export the software associated with the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service.

Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises do not promote, recommend or condone use of the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service during certain activities, such as automobile driving, where there is a significant risk of an accident. You agree not to use the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service during such activities.

You agree that Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises are free to use any comments, information or ideas contained in any communication you may send to Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises without compensation, acknowledgement or payment to you for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service or other products or services.

Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises PROVIDES THE Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises SERVICE "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, WHETHER EXPRESS, IMPLIED OR STATUTORY. Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. 

Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you.Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises assumes no liability or responsibility for any errors or omissions in the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service; any failures, delays or interruptions in the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service; any losses or damages arising from the use of the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service, including, without limitation, any damage to your mobile device; or any conduct by users of the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service. We reserve the right to deliver the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service in our sole and absolute discretion.

IN NO EVENT SHALL Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises , ITS SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS BE LIABLE (JOINTLY OR SEVERALLY) TO YOU FOR LOSS OF USE OR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises SERVICE OR THESE TERMS OF SERVICE, ON ANY THEORY OF LIABILITY, AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF DAMAGE. Some states do now allow the exclusion of certain damages, so the above may not apply to you. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.

You agree to indemnify and hold Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises, and its related companies, and each of their respective shareholders, directors, officers, employees, agents and merchant partners harmless from and against any third-party claim or cause of action, including reasonable attorneys' fees and court costs, arising, directly or indirectly, out of your use of the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service or your violation of any law or the rights of any third party.

YOU AGREE THAT THESE TERMS OF SERVICE OR ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER PREEXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, COMMON LAW AND EQUITABLE CLAIMS) BETWEEN YOU AND Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises arising from or relating to these Terms of Use, their interpretation or breach, termination or validity, the relationships which result from these Terms of Use, the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service, Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises advertising or any related transaction SHALL, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BE GOVERNED BY THE LAWS OF THE STATE OF WASHINGTON, WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. 

ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER PREEXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, COMMON LAW, INTENTIONAL TORT AND EQUITABLE CLAIMS) BETWEEN YOU AND Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises, its agents, employees, principals, successors, assigns, affiliates (collectively for purposes of this paragraph, Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises ) arising from or relating to these Terms of Use, their interpretation or breach, termination or validity, the relationships which result from these Terms of Use (including, to the full extent permitted by applicable law, relationships with third parties who are not signatories to these Terms of Use), the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service, Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises advertising or any related transaction SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION, IN ACCORDANCE WITH THEIR APPLICABLE RULES, OR ANY OTHER ESTABLISHED ALTERNATIVE DISPUTE RESOLUTION PROVIDER MUTUALLY AGREED UPON BY THE PARTIES. 

The arbitration will be limited solely to the dispute between you and Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises. NEITHER YOU NOR Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS OR ARBITRATE ANY CLAIM AS A REPRESENTATIVE OR CLASS ACTION OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. Any award of the arbitrator shall be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction. Each party shall pay its own costs and attorneys' fees. 

However, if any party prevails on a statutory claim that affords the prevailing party attorneys' fees, or if there is a written agreement providing for fees, the arbitrator may award reasonable fees to the prevailing party, under the standards for fee shifting provided by law. 

Any claim or cause of action arising out of or related to your use of the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service must be filed within one (1) year after such claim or cause of action arose, regardless of any statute or law to the contrary. In the event any such claim or cause of action is not filed within such one (1) year period, such claim or cause of action shall be forever barred. 

Choice of Law and Forum. This Agreement and the relationship between you and Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises shall be governed by the laws of the State of Washington "KING COUNTY" without regard to its conflict of law provisions. You and Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises agree to submit to the personal and exclusive jurisdiction of the courts located within Kings County, Washington.

PAYMENT AND FEES. Payment by Credit Card / Paypal. You hereby authorize Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises to charge your credit card as set forth in the Payment Method section of the Registration Form to a monthly Services fee, and overage fees to Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises at the rates set forth on Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises or agreed upon rate.

We reserve the right to suspend or terminate your access to the Alexa Skill or Google Action at any time and without liability.

You can disable the Voice App from your device at any time. If you do so, and would like us to delete your personal data from our systems too, please contact us so that we can do so.

Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises reserve the right in its sole discretion to terminate or restrict your use of the Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises service, without notice, for any or no reason whatsoever.

These Terms and the Privacy Policy (as amended from time to time) constitute the entire agreement relating to your use of the Alexa Skill or Google Action.

 If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties and all other provisions shall remain in full force and effect.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

 We may assign or otherwise transfer our rights and obligations in terms of these Terms to third parties.

These Terms shall be governed by and construed in accordance with USA law and you agree to submit to the exclusive jurisdiction of the WASHINGTON SATATE "KING COUNTY" Courts.

If any provision of these Terms of Use is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the extent or scope of such section. Our failure to enforce any provision of these Terms of Use shall not constitute a waiver of that or any other provision. These Terms of Use set forth the entire understanding and agreement between you and Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises with respect to the subject matter hereof. 

Non-Transferability. You agree that your Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises account is non-transferable, and this Agreement may not be assigned by you without Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises prior written consent.

Entire Agreement. This Agreement constitutes the entire agreement between you and Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises and governs your use of the Service, superseding any prior agreements between you and Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises with respect to the Service. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other services from Brand Voice, Guest Voyce, Briefcast, Bnb Voice,10X digital enterprises.

If you have enabled the Alexa Skill or Google Action and provided personal data to us, we shall retain your personal data until you notify us that you have disabled the Alexa Skill or Google Action.

 

If you have otherwise contacted us, we shall retain your data for 6 months from the date of contact.

 

If you receive marketing communications from us, we shall retain your personal data until you opt out of receiving such communications.

You can subscribe to receive marketing communications from us by giving us your email address . Once we have received your email address, we shall send an email to you so that you can confirm your consent. We retain evidence of the details of your consent.

 

You can choose to no longer receive marketing communications by contacting us or clicking unsubscribe from a marketing email. If you do unsubscribe to marketing communications, it may take up to 5 business days for your new preferences to take effect. We shall therefore retain your email address in our records for marketing purposes until you notify us that you no longer wish to receive marketing emails from us.

 

If you have given us your mobile telephone number, we may send to you marketing communications for the purposes of our legitimate interests. These communications may relate to our good and services, or the goods and services of our client.

 

To stop receiving SMS alerts, follow the opt-out instructions on the piece of direct marketing, or submit your mobile number to support@guestvoyce.com. We aim to ensure that any request to opt-out is dealt with within a 30 day period of receipt of the opt-out.
